The executives can sign what they like, but the contract is not enforceable until it is approved by the board.

In the American system, the President is tasked with negotiating treaties. For those treaties to become law, they must be ratified by the Senate.

In contract law, this is the same as a deal requiring board approval. The executives can sign what they like, but the contract is not enforceable until it is approved by the board. The Founders recognized the dangers of giving the President sole discretion in treaty making. He could use this power to circumvent the power of the legislature by striking deals with other countries that trumped US law. Everybody involved is leaving their oversight responsibility to the next guy. Voters expect politicians to keep the system within the lines. The politicians expect the staff to tell them when and what to do.

The answer is escalating levels of civil disobedience. The system counts on us continuing to do nothing but vote once every other November. If we keep doing that only, we are helping the tyrants take the country away from us. Soldiers and families of soldiers have sacrificed a ton for our Constitution and country. We can go sit in someone's air-conditioned office until the cops show up, can't we?

The board can say NO to Obama but never seems to.
If the 'board' were a Lady she begins with 'protesting too much' and then always seems to just lay back... and thinks of D.C.(England)
