Gigantic Canadian Legal Brainz discover woman can't consent to sex while unconscious

OTTAWA: The Supreme Court of Canada has ruled that an unconscious woman can't give consent to sex. -- Markosun's Blog
The ruling was 6-3 which means, I guess, that 3 "judges" thought it would be okay to fuck with her.

WTF, she was his wife... that applies consent right there. She also wanted him to choke her out. She just got pissed when she came to and he was using power tools on her. What the hell was HE trying to accomplish? They should both be shot and buried in the woods.

Don't misrepresent the story.

She consented to being choked and weird sex before she passed out, having passed out before under the same circumstances, and having consented in the past t.o both choking and weird sex

The dissenting judges rightly said that if you consent to all this crap your passing out as agreed does not end the consent.

She consented. Period.

It's all fun a games until someone gets screwed with power tools. Sounds as if he just got carried away. Can't they just play fantasy like the rest of us? I mean.. the fun is in the play. Geesh. There is kinky sex and then there is creepy sex. Creepy sex always ends badly. I don't mind the ruling, but these two seriously need mental help.
