In Texas, the 2003 Tort reform Act is a legal weapon used by the medical community to murder its citizens without accountability. Emergency rooms are especially immune from lawsuits because one has to prove "malice." proving "malice" is almost an impossibility.
So, Texans can rot in the Emergency Rooms without receiving The Basic Standard of care, having a blank chart when they finally make it to the floor, and die shortly thereafter.

Yesterday, when I posted my worthless two cents , I was still filled with anger from 2008.
But, today is another day.
My husband and I were married for 32 years and lived together for 34. He was murdered in University Medical Medical Branch, in Galveston Texas on April26, 2008. He was 57 years old.
The murder weapon was The Texas Tort Reform Act. It passed into law 2003. What the bill did was overhaul civil litigation by placing a cap of 250,000 on what they call "non-economical damages." This is the amount usually needed to generate a lawsuit against hospitals in Texas. The end result in The State of Texas is about 98 per cent of lawyers in our state will not touch a malpractice case-even if it is obvious murder, in the Emergency Rooms in this state. The so-called "Tort Reform Act" is a legal weapon used by the medical community to murder its citizens without accountability.
In the case of my husband, Cleveland Mark Mitchell, UTMB failed to deliver even "the basic standard of care."
Under Texas Law, negligent homicide, also referred to as involuntary manslaughter - is killing another person through gross negligence or without malice. It is characterized as death caused by "conduct grossly deviated from ordinary care." But "grossly deviated from ordinary care?" In this case, there was no care at all. The end result of a 17 1/2 hour stay was a blank ER chart. Failing to administer basic aid, then failing to be accountable, then trying to cover it up with bogus explanations, in my mind, that is murder.
The Basic Standard of Care is the basic measurement of the adequacy of medical-the recognized procedures for diagnosing and treating injuries and illnesses. The law recognizes that doctors and nurses and other medical providers can't guarantee successful treatment each time. But it does require these medical practitioners provide proper care to their patients. If what they do or do not do meet The Basic Standard of care, the hospitals are liable for injuries and the harm that result. This includes the death of a patient. Again, in my husband's case, the chart was blank. The basic standard of care was never given.
We arrived to UTMB at about 16645. We was placed in a holding area about 1730. At about 1800, a resident and a few medical doctors walked in. My husband told them he had abdominal pain. The resident palpated his abdomen for about less than a second. He ordered the minimal dose of Morphine IV. The nurse came in a few minutes later, started a saline lock, and administered the minimal dose of morphine That was it. Nobody ever returned to see if the Morphine was effective. Nobody came to check on him period. Nobody came to help him when I pleaded to the nurse who sat in front of the desk he needed more medication for pain. Nobody came in when I asked the nurse when he could see a doctor. And the end result was a blank ER chart because nobody did a thing. He literally was left forgotten in the ER. I was the only person in that hospital who knew he was there. I was the only person who even knew who he was.
Some time between 0730 and 0800, the nurse who had administered the minimal dose of Morphine was surprised to see us and asked, "are you still here?"
At about 1015 that morning, a nurses aide came in ad took a set of vitals That was all that was done for the duration of 17 1/2 hours in the Er, except for a minimal dose of Morphine the evening before.
When he arrived to the 6th floor, he was being wheeled to his room by stretcher and I heard one of the nurses tell another, "and he came up without labs, xrays, without nothing..nothing." When my husband was in his room, he was in renal shut down, had a cardiac condition due to his potassium level being high and suffered a stroke. (I read the EKG and it looked like a heart attack, but since I am not a physician, for legality sake, it was a cardiac condition).
After he died, I tried to get answers and accountability. I took my chart to Senator Mike Jackson's office and asked him why he was allowed to rot in the ER. He had no answers. I took my plight to Ron Paul. Again I asked the same question. He too, did not have any answers. I wrote to Governor Rick Perry, the Governor who signed the 2003 Tort reform Act, but still did not receive any answers.
I wrote to The Texas Medical Board and every legal agency having the power to look into this matter. Still no answers. I wanted to know why a 7 day post op abdominal hernia repair patient was admitted to the ER with acute abdominal pain, his medical records in their computer data base, with ER pedestrian traffic normal, and was left to rot in their ER.
The 2003 Texas Tort Reform Act was the murder weapon used to kill my husband in the hands of UTMB, Galveston Texas, Senator Mike Jackson, Congressman Pau, David Callender, President of UTMB, and Governor Rick Perry because they all failed to be accountable and covered my husband's death with silence.
Under the Texas Penal Code 19.05, a person commits criminally negligent homicide is he causes the death by criminal negligence "under Penal Code 6.03 (d).
Part of the definition of homicide is characterized as a death by conduct which is deviate from ordinary care. My husband not only did not receive the basic standard of care, but his chart supports my accusation.
The people I have mentioned and the agencies involved knew they could get away with murder, and the did. The Texas 2003 Tort reform Act made it an impossibility to take them into court or get any answers. The were free, and still are free to get away with murder because of this Act.
Imagine this happening to your loved one, someone you cherish more than life itself. Then maybe you to can call this murder in your heart.
Imagine how much worse it will be under Government Obama Care.

Clarification: The EKG was done about 5 hours after his arrival to the floor. I saw the medical records and found the EKG a couple of months after his death. I interpreted the EKG as indicative of a heart attack, but since I am not a physician, I can not make the diagnosis. The labs also were taken after his arrival to the floor. The nurses were blind sided because they had a critical patient to take care which consisted almost of a 1:1 patient care. If labs were done and and EKG done in the ER, he would have possibly been taken to ICU. It is standard procedure to give report to the receiving nurse when transferring any patient from any area. The fact that nothing was done during the duration, probably is why I overheard the nurse sate this to another.
