It's Not the Lawyers. It Might Be You

America is not failing because of lawyers.

A story: My first year in law school I had a class on Torts - private law suits for damages. One example was a man had a dump pickup. The bed jammed in the upright position, so he leaned over the frame, the bed rails, and started fiddling with the hydraulics. He released the pressure in the hydraulic system and the bed came down and crushed him against the frame.

Now I had driven similar trucks at the camp since I was in high school - for about nine years. I knew that even the oldest trucks we had - one went back to the early 1970's - had a prop-pole alongside the bed that could be raised if the hydraulics were being worked on, to keep the bed up in the air, to support the bed.

The man in the law problem did not raise the prop. I was asked by the prof what my opinion of the case was. I said that it proved that half of the people in this country were dumber than the other half (after I noted the presence of the prop on all Ford dump pickups of my acquaitance).

She then asked if I really believed that. I had no answer, I was struck dumb. By definition my answer was correct, and the prop was standard equipment. The fact the man in the problem was part of one 50% (or may have suffered a Sudden Unintelligence Incident) was no blame to the manufacturer.

The lawyers would not be doing these things, and getting rewarded for doing so, if those hiring them and the juries on these cases did not want them to do this.
