...using powerful argument techniques like misdirection, non sequitor, ad hominem, and, of course, the always useful characterization of those he opposes as "fascists," after casually misstating their positions. I award Johnson this week's spittle cup for despicable analysis wherein hate replaces fair reading and rational reply. Johnson finds his proper media home at CNN. A few more posts like this and he'll be ripe for MSNBC stardom.

There is no issue with regard to a defendant's right to counsel. They have that right.

There is no issue of guilt by association between counsel and defendant. There should be none.

The issue is: What does it say about the Department of Justice that they are now now employing so many lawyers who helped represent alleged Al Qaeda terrorists in Guantanamo?

Perhaps it means nothing. Perhaps it is mere co-incidence. But are you saying, Gerard, via your favorable link to Johnson, that we should be ashamed to take notice?

Are we "dangerous" people with "lunatic ravings and fantasies"? Do we suffer from "ineptitude and ignorance to the issue of jurisprudence"?

Are we acting "like a fucking moron"? Are we just "retards" spouting "fascistic nonsense"?

Perhaps we are but, then, what say you to Johnson's ducking for cover, when it is pointed out that the drool cup may be under the wrong chin?

Says Johnson:
"I have no problem with legislative oversight and seeking an answer to the question, “Are lawyers who represented clients at Guantanamo now setting policy on the issue at DOJ?” That is a legitimate question. Under judicial ethics a lawyer who had a material interest in a case while in the private sector must recuse himself or herself from working on that case if they hold a government job."
